Effective date: 2026-10-17
Version: 1.0
1. Scope and relationship to other terms
These Email Sending Terms supplement the Terms of Service between you and nith LLC (nith, we, us), the operator of EasyAsPie. They apply to email that you direct a site to send through EasyAsPie, including newsletters, promotional campaigns and invitations to subscribe. You must have authority to act for the business identified in the messages and to accept these terms for it.
The Acceptable Use Policy also applies. The Agency and Commerce Terms apply where relevant, and an applicable, entered-into Data Processing Addendum governs processing on your behalf. These Sending Terms control conflicts specifically about tenant email sending, subject to the Data Processing Addendum for personal information processing and any expressly agreed variation under the Terms of Service.
EasyAsPie's own account, authentication, security, billing, legal and service notices are separate from your marketing. Accepting these terms does not subscribe you or your recipients to marketing from EasyAsPie.
2. Sender identity and domains
Your site may use its assigned address under notify.piesite.cloud, or an eligible custom sending address. The assigned address is part of the service, not a domain or mailbox you own. It does not include an inbound email service. Keep your business contact and Reply-To address accurate and monitored.
A custom sender name or sending domain requires an attached, verified website domain. A custom sending domain must also pass the displayed email-authentication checks. You must have authority over the domains and names you use and maintain the necessary DNS records.
If a custom sender becomes ineligible or unavailable, the site's assigned tenant address may become its effective sender. Sending remains subject to all approval, terms, recipient and safety checks. A rejected tenant message is not retried from EasyAsPie's internal notifications@easyaspie.site address.
Do not impersonate EasyAsPie, another business or an individual. Reserved service identities, including security identities, are not marketing aliases.
3. Setup and approval
Before marketing can go to people outside your site's team, you must:
- accept the current approved version of these terms through an authorized site administrator;
- have a usable tenant sending address;
- provide an accurate, complete business mailing address;
- publish a privacy notice appropriate to your newsletter and its measurement; and
- obtain EasyAsPie's sender approval for the site.
Approval remains subject to provider availability, account restrictions, sending limits and our safety controls. Domain verification alone does not authorize subscriber sending. We may require a new review after changes to the site's ownership, mailing address or sending domain.
Tests are restricted to the recipients the service permits. A successful test is not approval to send to subscribers. A team membership, contact-form submission, purchase, booking or website visit is not newsletter permission by itself.
Necessary service messages, such as supported receipts or signing links, follow their own restricted delivery paths. They must concern the relevant service or transaction and must not be used to carry unrelated marketing. Calling a message a receipt or security notice does not determine its legal treatment.
4. Permission and subscriber lists
International customers and recipients may use supported sending features where available and lawful. You must identify and comply with the laws applicable to your business, recipients and messages. The confirmation requirement below applies to every site's newsletter, regardless of location. EasyAsPie's rules may be stricter than the minimum that a particular law permits.
Newsletters may go only to people who requested that site's newsletter and completed the service's confirmation step, and whose subscriptions remain active. Keep the subject matter and frequency within what they agreed to. Permission for one site, client or purpose does not authorize another.
Do not import, paste or otherwise add external mailing lists, or subscribe people on their behalf. Purchased, rented, shared, scraped, harvested, guessed and generated lists are prohibited. Do not offer incentives for people to subscribe someone else's address.
Where the invitation feature is available, an existing business contact may receive no more than one invitation per site, and only if that person has already given documented permission for marketing from that site's business and has not withdrawn it. Record the permission date and evidence reference, and confirm that you can provide the evidence. A customer relationship or past enquiry alone is not enough under this initial policy. The invitation confirms the subscription; it does not create permission to send itself. You must also meet any further requirements of applicable law. Do not use invitations for cold outreach, withdrawn consent, a complaint or a suppressed address. No response is not consent.
You must retain any additional evidence needed to establish permission. A technical confirmation or EasyAsPie approval does not by itself establish that every applicable legal requirement has been met.
5. Required message information
Identify the business being promoted accurately. Use truthful sender details and subject lines, and identify advertising where required. Do not disguise marketing as a personal message, security alert, password reset, bill or service notice.
Keep the mailing address, business identity, privacy link and unsubscribe information supplied by the service visible and accurate. Newsletter footers use the effective sending address; any separate Reply-To address must still identify a contact the recipient can reach.
Do not remove or obstruct unsubscribe links or headers, or add misleading links, malware, phishing or unlawful content. Do not place regulated health information or other data prohibited by the Terms of Service into lists, messages, segmentation or tracked links. A health-related website does not authorize regulated clinical messaging.
6. Unsubscribes, bounces and complaints
Recipients must be able to stop marketing without signing in, paying or supplying unnecessary personal information. The service provides a newsletter unsubscribe link and supported one-click unsubscribe headers. You must honor requests received by other channels promptly, using the service to stop further marketing and meeting any shorter applicable legal deadline.
An unsubscribe applies to that site's newsletter. Spam complaints suppress the address on the affected list. A permanent bounce may suppress existing subscriptions on other EasyAsPie lists as well. Delivery providers may impose additional restrictions.
Do not override suppression, reinvite someone who opted out, move an address to another site to evade a choice, or sell or transfer opted-out addresses except where law permits for administering the opt-out. A recipient's later voluntary subscription must use the service's confirmation process; it does not authorize you to clear a bounce or complaint restriction.
7. Link measurement and privacy
Newsletter click measurement is available for supported newsletters, but a recipient must make a separate, affirmative choice before links in that recipient's future newsletters are measured. The choice is optional and is not preselected. Recipients who decline, have not chosen, or withdraw the choice may continue receiving newsletters without application-requested click measurement. Existing subscribers are not treated as having opted in.
Where enabled, email delivery and measurement providers may process message and recipient identifiers, the clicked destination, event time, IP address, browser or device information, and indications of automated activity. A recorded click does not necessarily mean a person clicked it. Explain these purposes and recipients in the applicable privacy notice.
Open tracking is off. Service-message, unsubscribe and email-preference links are excluded from application-requested newsletter click measurement. A recipient can change the tracking choice using the email-preference link without unsubscribing. Changes apply to future messages; links already delivered may still use the delivery provider's existing redirects. Do not promise that withdrawal rewrites delivered mail or erases records already lawfully retained.
Your acceptance of these terms is not a recipient's consent to marketing or tracking. Meet any additional requirements applicable to your audience and the particular processing; the availability of a platform control is not a determination of worldwide lawfulness.
8. Sending health, limits and delivery
We may limit volume, pace sending, apply lower limits to new senders, or pause sending in response to bounces, complaints, abuse, security risks or provider requirements. Current limits and sender status are shown in the service where available. Limits are protective controls, not a purchased delivery guarantee.
Do not evade a pause, refusal, approval requirement or limit by changing addresses, domains, sites or accounts. We may request evidence about your business, lists, signup process and messages, and review that evidence for operating and protecting the service.
Delivery, inbox placement, display of a brand logo and complete event measurement are not guaranteed. Provider restrictions can affect several tenants even when their domains differ. Separate platform and tenant sending services do not guarantee uninterrupted delivery.
9. Review, suspension and appeals
We may delay or refuse messages, pause sending, withdraw sender approval or disable the email feature where reasonably necessary to address a breach, credible abuse or security risk, legal requirement or provider restriction. Where practicable and lawful, we will explain the reason and the steps needed for review. Urgent protective action may occur first.
You may report suspected email abuse or request review at abuse@easyaspie.site. Include the affected site and relevant message information, but do not send passwords, access keys or unnecessary recipient data.
A sending pause does not by itself terminate your website or account. Other restrictions and termination follow the Terms of Service. Neither review nor approval transfers your obligations to us or excludes our own legal responsibilities.
10. Personal information, records and retention
You determine the business purposes, content and intended recipients of your site email, and must provide the required notices and lawful instructions. Agency users must also have their client's authority. Our responsibilities for processing on your behalf follow the applicable Data Processing Addendum and Terms of Service. Our own security, abuse-prevention and service-administration processing is described in the Privacy Policy.
The service records subscription and confirmation information, recipient choices, sending and delivery events, and acceptance of sending terms. For an invitation it also records the permission date and evidence reference you supply, the confirmation wording and the relevant sending actor and time. Keep the actual evidence available; the reference is not a finding by EasyAsPie that permission is valid. Providers also process information to deliver mail, handle events and protect their services. Applicable providers are described in the Provider Inventory.
The email-record schedule is: delivery and troubleshooting copies of message content for up to 90 days after sending or the final failed attempt; delivery and click records for up to 12 months after the related message; and consent, invitation-permission and terms-acceptance evidence during the relevant relationship and for three years after it ends. Subscriber evidence clocks start at unsubscribe or suppression; an unaccepted invitation's clock starts when it expires. An accepted invitation follows the resulting subscription's evidence clock. Terms-acceptance evidence follows the end of the site's sending service. Tenant-authored drafts and campaign archives are separate customer content retained until the tenant deletes them or closes the site, subject to applicable data terms.
Minimal records needed to honor unsubscribe, suppression and tracking withdrawal remain while the relevant sending service operates, for that limited purpose. Removed active-system data ages out of service-managed backups within 90 days. A documented dispute or legal hold may require a limited, reviewed exception; only authorized platform staff may impose or release it. Available exports and request handling remain subject to the applicable data terms. Do not treat the newsletter service as your only record of permission. Ending a site does not excuse outstanding opt-out obligations or permit reusing its suppressed list.
11. Charges and contractual responsibility
Any charges and allowances are those separately disclosed and agreed under the Terms of Service or your order. These terms do not create a new price, sending allowance, paid certificate entitlement or right to production email access.
You remain responsible for your business's lists, content and instructions. The Terms of Service govern liability and third-party claims; these Sending Terms do not add a separate indemnity, penalty pass-through or liability exclusion, or limit rights that cannot lawfully be excluded.
12. Changes and stopping use
We will email each current site owner and administrator and display a dashboard notice before a material new version becomes required. For an ordinary material change, the site's notice period starts only after all required email notices have been successfully handed to the delivery provider, and the new version cannot become required for at least 30 days after that time. Failed or uncertain handoffs delay activation; provider handoff does not guarantee inbox delivery. An earlier change may be necessary for law, a provider requirement, security or abuse prevention, with the reason documented. When a new version becomes current, sending subject to these terms pauses until an authorized administrator accepts it.
You may temporarily pause sending or separately end the site's sending service. Ending that service cancels queued newsletters and ends its subscriptions. Restart requires fresh terms acceptance and sender review, and does not reactivate old subscriptions. Stopping use does not erase recipient choices or records retained under the applicable data terms. If you do not accept a new version, you may continue other eligible services under the Terms of Service.
